CONCEITO SOBRE OS PRINCÍPIOS E GARANTIAS CONSTITUCIONAIS CONTIDOS NO HABEAS CORPUS
Abstract
The present study aims to understand the Habeas Corpus, elucidating the principles and guarantees for its effectiveness from the perspective of the Federal Constitution of 1988. and published between the years 2012 and 2022, which were still linked to the present theme in the databases of Revista Jurídica do MPRO, Scielo and Google Scholar. Based on the results obtained, we came to the conclusion that the principles and constitutional guarantees used to increase the effectiveness of Habeas Corpus are considered fundamental for the survival of the human person, since such rights protect their dignity. The fundamental guarantees ensure that individuals have a dignified, free and equal existence, which is why they are called essential in constitutional terms. Based on the principles of human rights, there is the basis of social interaction. Another fundamental factor resides in the legislative changes implemented over the years that were established with the objective of providing greater harmony in the social context, in view of the protection against abusive and/or harmful acts to the right of locomotion.
Resumo
O presente estudo tem por objetivo compreender o Habeas Corpus, elucidando os princípios e garantias para à efetividade desse sob a ótica da Constituição Federal de 1988. No estudo foi empregada a metodologia de revisão bibliográfica de cunho descritivo, a qual foi disposta sobre conteúdos científicos selecionados e publicados entre os anos de 2012 e 2022, que seguiam ligados ao presente tema nas bases de dados da Revista Jurídica do MPRO, Scielo e Google Acadêmico. Com base nos resultados aferidos chegamos a conclusão que os princípios e garantias constitucionais utilizados a elevar a efetividade do Habeas Corpus são considerados fundamentais para a sobrevivência da pessoa humana, visto que tais direitos protegem sua dignidade. As garantias fundamentais asseguram aos indivíduos uma existência digna, livre e igualitária, por isso recebem a designação de essenciais em matéria constitucional. Com base nos princípios de direitos humanos, tem-se a base da interação social. Outro fator fundamental reside nas mudanças legislativas implantadas ao longo dos anos, que foram estabelecidas com o objetivo de proporcionar maior harmonia no contexto social, em face da proteção contra atos abusivos e/ou lesivos ao direito de locomoção.
