AÇÃO DE IMPUGNAÇÃO DE MANDATO ELETIVO: FRAUDE À COTA DE GÊNERO
Abstract
This article talks about the Elective Mandate Challenge Action as a constitutional instrument capable of curbing the abuse of economic power, corruption or fraud. The idea of constituent power was to make a powerful tool available in the legal system with immediate effectiveness, even if it did not achieve the objectives contained in the standard for the ideal implementation. Currently, the position of the Superior Electoral Court is observed, corroborating the guarantee, maintenance and operation of this legal device, through judgments and jurisprudence, with the dictates of the law prevailing. Thus, we arrived at the following research problem: how is AIME used to combat gender fraud? The methodology used was bibliographical research, analysis of texts, articles, related legislation, addressing aspects related to the conditions of actions, constitutional assumptions, the procedural course, the results of sentencing sentences, the legal understanding of what comes to be gender quotas and combat gender quota fraud, in accordance with the Electoral Court, doctrine and jurisprudence.
Resumo
O presente artigo fala acerca da Ação de Impugnação de Mandato Eletivo como instrumento constitucional capaz de coibir o abuso de poder econômico, corrupção ou fraude. A ideia do poder constituinte foi disponibilizar uma ferramenta poderosa no ordenamento jurídico com eficácia imediata, ainda que não tenha alcançado os objetivos contidos na norma para a concretização idealizada. Observa-se, na atualidade, o posicionamento do Tribunal Superior Eleitoral corroborando para a garantia, manutenção e funcionamento deste dispositivo legal, por meio de julgados e jurisprudência, prevalecendo os ditames da lei. Assim, chegou-se ao seguinte problema de pesquisa: como a AIME é utilizada para combater fraudes à conta de gênero? Utilizou-se como metodologia, a pesquisa bibliográfica, análise de textos, de artigos, da legislação relacionada, abordando aspectos correlatos às condições das ações, os pressupostos constitucionais, o curso processual, os resultados das sentenças condenatórias, o entendimento legal do que vem a ser cotas de gênero e combate à fraude à cota de gênero, de acordo com a Justiça Eleitoral, a doutrina e a jurisprudência.
