GUARDA COMPARTILHADA COMO MEIO DE PRECAVER A ALIENAÇÃO PARENTAL
Abstract
This is a study on the application of shared custody as a method of preventing parental alienation. To this end, the general objective was to analyze how the use of the joint custody institute can act in preventing parental alienation. As specific objectives, we sought to describe contemporary family formation and the factors that enable the emergence of parental alienation; assess the consequences of parental alienation for children or adolescents; and demonstrate how the adoption of shared custody can prevent parental alienation. Aiming to elucidate the topic addressed, bibliographical research was carried out, using books, magazines, articles and legislation that deal with the subject. The main authors are: Duarte and Abrahão Neto (2022), Schreiber (2020), Tartuce (2021). At the end of the research, it was possible to identify that parental alienation has severe consequences for minors, which can harm their healthy development and generate unwanted feelings that can persist into adulthood, therefore demonstrating that the measures imposed in the face of parental alienation do not they may be subsequent to its practice, but rather, preventive. It is from this stance that it was possible to identify shared custody as a preventive method of parental alienation due to its rules allowing both parents to live together with their children, attributing joint responsibility for the minor.
Resumo
Trata-se de estudo sobre a aplicação da guarda compartilhada como método de prevenção da alienação parental. Para tanto foram traçados como objetivo geral analisar como a utilização do instituto da guarda compartilhada pode atuar na prevenção da alienação parental. Como objetivos específicos buscou-se descrever a formação familiar da contemporaneidade e os fatores que possibilitam o surgimento da alienação parental; avaliar as consequências da alienação parental para as crianças ou adolescentes; e demonstrar como a adoção da guarda compartilhada pode prevenir a alienação parental.. Visando elucidar o tema abordado foram realizadas pesquisas bibliográficas, utilizando-se livros, revistas, artigos e legislações que tratam sobre o assunto. Tendo como principais autores: Duarte e Abrahão Neto (2022), Schreiber (2020), Tartuce (2021). Ao final da pesquisa foi possível identificar que a alienação parental acarreta severas consequências aos menores, podendo prejudicar o seu desenvolvimento saudável e gerar sentimentos indesejados que podem se manter até a vida adulta, evidenciando, portanto, que as medidas impostas em face da alienação parental não podem ser posteriores a sua prática, mas sim, preventivas. É a partir desta postura que foi possível identificar a guarda compartilhada como método preventivo da alienação parental em virtude de seu regramento possibilitar o convívio de ambos os genitores com seus filhos, atribuindo a responsabilidade conjunta pelo menor.
