A DEFENSORIA PÚBLICA COMO INSTITUIÇÃO DE MEDIAÇÃO DE CONFLITOS: UMA ANÁLISE DA DEFENSORIA PÚBLICA DE PINHEIRO/ MA
Abstract
This work discusses how the Public Defender's Office has been working to resolve and mediate conflicts, analyzing the Public Defender's Office of Pinheiro/MA. It discusses how the evolution and access to Social Justice occurred and the role of mediation in resolving conflicts, identifying the role of the Public Defender's Office in resolving these controversies. It analyzes how this scenario has been relieving the Judiciary, the application of mediation in the practice of the Pinheiro Public Defender's Office, showing quantitative data. The evolution of the Public Defender's Office in the Brazilian legal system and its contributions to effective access to justice are reported, drawing a parallel between access to the Judiciary and access to justice. The contributions of the Public Defender's Office to access to justice in a broad sense are emphasized. Afterwards, the adoption of mediation in the work of the Public Defender's Office stands out. Finally, the experiences of mediation in the Public Defender's Offices of the municipality of Pinheiro/MA are explained.
Resumo
Discutem-se, no presente trabalho, como a Defensoria Pública vem atuando na resolução e mediação de conflitos, fazendo uma análise da Defensoria Pública de Pinheiro/MA. Aborda-se como se deu a evolução e o acesso à Justiça Social e o papel da mediação na resolução de conflitos, identificando o papel da Defensoria Pública na resolução dessas controvérsias. Analisa-se como tal cenário vem desafogando o Poder Judiciário, a aplicação da mediação na prática da Defensoria Pública de Pinheiro, mostrando dados quantitativos. Relata-se a evolução da Defensoria Pública no ordenamento jurídico brasileiro e suas contribuições para o efetivo acesso à justiça, traçando um paralelo entre o acesso ao Poder Judiciário e o acesso à justiça. Enfatizam-se as contribuições da Defensoria para o acesso à justiça em sentido amplo. Após, destaca-se a adoção da mediação nos trabalhos da Defensoria Pública. Por fim, são explicitadas as experiências da mediação nas Defensorias do município de Pinheiro/MA.
