O USO DE CRITÉRIOS PARA PRECISÃO DOS MEIOS VIOLENTOS
Abstract
This article intends to analyze the term violence with regard to the use of criteria for the accuracy of violent means in Benjamin and Arendt. To support this analysis, Benjamin and Arendt's ideas were used as reference, in the works Documents de Culture Documents de Barbary (1986) and Crises da Republican (2006), respectively. Benjamin, when dealing with the critique of violence, understands that the analysis of violent acts can be defined as submission of their relationship with law and justice. For Arendt, in this work, every violent action has its means and its ends, but in human affairs, there must be a greater concern with these ends because such ends can be “overwhelmed” by their means. Based on these premises, the definition in relation to violence, natural law, positive law and the use of means to achieve ends with regard to violence was discussed. It was concluded that the search for the achievement of the desired ends might lead to the use of any means without criteria. Thus, it is necessary to weigh the means, even with the use of fair means and fair ends. It is necessary to look not only at the ends, but also in all actions to seek the means that best serve to carry out the action.
Resumo
Pretende-se, neste artigo, analisar o termo violência no que diz respeito ao uso de critérios para precisão dos meios violentos em Benjamin e Arendt. Para subsidiar esta análise utilizou-se como referência as ideias de Benjamin e Arendt, nas obras Documentos de Cultura Documentos de Barbárie (1986) e Crises da República (2006), respectivamente. Benjamin ao tratar da crítica da violência entende que a análise dos atos violentos pode ser definida como submissão de suas relações com o direito e a justiça. Para Arendt nesta obra toda ação violenta tem seus meios e seus fins, mas nas questões humanas deve ocorrer uma preocupação maior com estes fins pois tais fins podem ser “sobrepujados” pelos seus meios. Partindo destas premissas, discutiuse a definição em relação a violência, ao direito natural, ao direito positivo e ao uso dos meios para atingir os fins no que diz respeito à violência. Concluiu-se que que a busca pela realização dos fins almejados poderá levar ao uso sem critérios de qualquer meio. Assim, é necessário sopesar os meios, mesmo com a utilização de meios justos e também de fins justos. Há que se olhar não apenas para os fins, mas em todas as ações buscar os meios que melhor servem para a realização da ação.
